("we"). You are the person who orders a gift ("you"). We call the person who receives the gift the "recipient".
A "consumer" in these terms is anyone who does not act for their business (§ 1 Austrian Consumer Protection Act, KSchG).
2. Service
Tadawink provides a digital gift: an animated 3D gift with a personal card in the card language you choose. Depending on your choices this includes a variant, a quantity, a custom text on the gift and, as extras, a voice message or a handwritten note.
We deliver the gift to the recipient by email or unlock it at a link you share yourself, also as a QR code. Delivery happens right away or at a time you choose in the recipient's time zone, at most 30 days ahead.
The gift is fully delivered once it is delivered or unlocked. After that it stays available to view for one year. Then we delete the content. We aim for high availability but do not guarantee uninterrupted access.
3. Ordering and conclusion of contract
Gifts and prices shown are not yet a binding offer. With "Order with obligation to pay" you place a binding order. You then pay via Stripe. The contract is concluded once the payment is confirmed. If you do not pay within 30 minutes, the order expires. You get an order confirmation by email with a link to manage the gift.
You must be 18 or older to order.
We do not store the contract text separately. The essential details are in the order confirmation.
4. Prices and payment
The prices shown when you order apply. They are final prices. The taxes of your country are included. Link calculates and pays them for us. You can pay in the currency you chose on our site. If checkout offers your local currency, Stripe converts the amount. Stripe adds 2 to 4 % to the exchange rate for this.
Your contract for the gift is with us. Link handles the payment for us. Link is part of the Stripe group (Sold through Link, LLC). That is why the checkout and the receipt say "Sold through Link". Link is the merchant of record for the payment and counts as the seller for sales tax and VAT. Link collects the amount, pays the taxes and sends you the receipt and invoice. Paying Link means you have paid us. Your bank statement shows "LINK.COM* TADAWINK".
Link's terms for purchases "Sold through Link" also apply to the checkout: link.com/terms. Link's support can also help with payment questions: support.link.com.
We are responsible for the gift: design, delivery, availability and statutory warranty. Your right of withdrawal is against us (section 8). Link may also refund a payment under its own rules. Section 9 then applies.
5. Your content
You are responsible for names, message, custom text, handwriting and voice message. You confirm that
- the content is not insulting, threatening, discriminatory or otherwise unlawful,
- you hold the rights to it, in particular to other people's voices and names,
- you only record people in voice messages who have agreed to it,
- you may use the recipient's email address for this gift.
You allow us to store the content for the period in section 2, adapt it for display and show it to everyone with the link. We do not review content in advance.
How we handle reports: Every card has a link to report it. A person on our team reviews every report. We do not use automated detection. If content breaks the law or these terms, we block the gift. We then email you what we blocked and why. If you disagree, reply to that email. We will review it again. You can also contact the Internet Ombudsstelle or a court. A gift blocked for a breach is not refunded.
6. Delivery
You are responsible for the recipient's email address being correct. If the email does not arrive, we let you know by email. The recipient sees the card in the language you chose and cannot switch it.
7. Changing, cancelling, deleting
You can change or cancel a scheduled gift through your manage link until 15 minutes before the delivery time. If you cancel, you get the full amount back. A gift with immediate delivery cannot be cancelled. Your statutory right of withdrawal is explained in the withdrawal policy.
You can delete a gift through the manage link at any time. After delivery, deleting does not lead to a refund.
8. Right of withdrawal for consumers
As a consumer you have a right of withdrawal. When it ends and how to use it is explained in the withdrawal policy. You can also withdraw online at Withdraw from contract here.
9. Refunds and chargebacks
You can get a refund through your manage link (section 7), by emailing us or through Link's support. Link may refund up to 60 days after the purchase.
If we or Link refund a payment, we delete the gift's content and the link stops working. If a payment is charged back through the payment provider, we block the gift. If the chargeback is unjustified and decided in your favour, we lift the block.
10. Warranty and liability
For consumers the statutory warranty applies. We are liable without limit for intent, gross negligence and personal injury. For slight negligence we are not liable to businesses. Towards consumers, liability for slight negligence is excluded unless it concerns personal injury or damage to items we took over for processing. Mandatory statutory liability, in particular under the Product Liability Act, remains unaffected.
11. Changes to these terms
Your order is governed by the version published when you ordered. Later changes only apply to new orders.
12. Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. You can sue us in Austria or in your country of residence. We sue consumers only in their country of residence. For disputes with businesses, the competent court in Wien has exclusive jurisdiction. Out-of-court dispute resolution is described in the imprint.
13. Final provisions
If individual provisions are invalid, the rest remain valid. You can conclude the contract in German or English. The language of your order applies.
